Direito à saúde: novo relatório sobre a COVID-19 | ICJ / CIJ

«New ICJ global report shows that the right to health must be central to State responses to COVID-19. SEPTEMBER 1, 2020. In a new report published today, the ICJ called on all States to ensure that their responses to the public health emergency brought on by the COVID-19 comply with the international human rights law and the right to health. The report emphasized the particularly acute and discriminatory impact of the pandemic on already marginalized people and the need for access to health facilities, goods and services necessary to combat COVID-19 without discrimination. The report «Living Like People Who Die Slowly: The Need for Right to Health Compliant COVID-19 Responses» documents the adverse human rights effects wrought by the COVID-19 pandemic. The title comes from the words of Mama Yuli, an Indonesian transwoman, who has said that the pandemic left many elderly transwomen feeling like “they live like people who die slowly”. International Commission of Jurists | 01-09-2020».

While the world is focusing on the global health effects of the pandemic, rule of law and human rights violations are taking place, daily, unaccounted for:

• Failure to access healthcare of all people in India, Libya and South Africa;
• Enacting effective bans on abortion in some states in the USA;
• Failure to adequately tackle skyrocketing domestic violence around the globe during lockdown;

Direitos Humanos em tempos de COVID-19

As of 8:00am CET this morning, the Coronavirus COVID-19 Global Cases tracker by the Center for Systems Science and Engineering at Johns Hopkins University in the US recorded 26,309,711 confirmed cases of individuals who had contracted the COVID-19 disease in 188 countries, and 868,805 people who had succumbed to the virus. Against this background, the aim of this blog is to highlight the necessity of ensuring the consistency of public health policies taken as part of the global responses to the COVID-19 pandemic with human rights law and standards. 

As outlined in a prescient 2019 Lancet Commission report – The legal determinants of health: harnessing the power of law for global health and sustainable development – the law, and a firm commitment to the rule of law, play a critical role in the pursuit of global health with justice.

The guide focuses on the existing guidelines, recommendations and statutory regulations adopted on the use of AI as a professional tool throughout the world. AI is in the focus of all economy sectors: from manufacturing to service; technology to transportation; healthcare to farming; and financial to legal service. It will be an inestimable value and indispensable in the business of the legal profession far beyond from what we are describing today as ‘Legal Tech’. Legislation is likely to need to be changed and general rules on professional ethics and liability will be available. (2) IBAHRI - The International Bar Association’s Human Rights Institute. - «IBA - IBAHRI statement at the United Nations Human Rights Council high-level panel discussion on the question of the death penalty. Human Rights Council, 42nd session, 11 September 2019. - Mr President, The International Bar Association’s Human Rights Institute (IBAHRI) notes the report of the high-level panel discussion on the question of the death penalty. We welcome positive steps taken by some states, including the executive moratorium on the death penalty in California, as well as measures in Colorado, Pennsylvania and Oregon. The decision of US Attorney General Barr to reinstate the death penalty 6 is therefore an unacceptable retrogressive step, as is Sri Lanka’s intention to reinstate the death penalty and seek execution of four people.

The IBAHRI opposes the death penalty without exception. We therefore condemn the imposition of the mandatory death penalty against two men in Myanmar for their role in the murder of prominent human rights lawyer, U Ko Ni. In addition, while we fully advocate the enjoyment of rights by persons with albinism, we condemn the court decision in Malawi, sentencing three people to death for killing and dismembering of a person with albinism.

As noted by the high-level panel, the death penalty is incompatible with the right to life, human dignity and the possibility of offenders’ rehabilitation. We call on states to immediately abolish the mandatory death penalty, observe a moratorium on the death penalty with a view to abolishing it and refrain from taking retrogressive steps».
